妻服父喪夫外遇　男中醫師判賠202萬

【劉志原╱台北報導】台中市林姓中醫師遭妻指控，5年前趁岳父出殯時，與宜蘭的一名潘姓女中醫師通姦，林妻向潘女求償350萬元後，今年5月間獲判賠100萬元；潘女的丈夫楊男，也控告林男通姦，雙方調解後，林男同意賠楊男202萬元，但後來林男後悔不付錢，楊男提告後，台北地院今判林男應履約付202萬元；仍可上訴。

林姓中醫師認為，雙方在去年4月調解時，楊男曾說，若調解不成立，他就要去林姓中醫師的診所自殺，加上前年2月，楊男曾經打電話來說：「要讓你家破人亡」等語，他心生恐懼才同意和解，且妻子控告潘女僅獲判賠100萬元，要他賠潘女的丈夫楊男202萬元並不公平。

法官認為，雙方對簿公堂，楊男是否自殺，林姓中醫師應不會在意，至於恐嚇電話，則是發生在調解庭的1年多前，是否持續令人心生畏怖，令人質疑，今判林姓中醫師敗訴須履約賠償。
